Rules & regulations

Telephone Consumer Protection Act

The Telephone Consumer Protection Act (TCPA) is a US federal law that regulates telemarketing calls, auto-dialed calls, pre-recorded calls, text messages, and unsolicited faxes.

The law requires telemarketers to obtain prior express written consent from consumers before contacting them for marketing purposes via phone calls, text messages, and faxes.

The TCPA also requires telemarketers to provide a way for consumers to opt-out of receiving future messages. The law sets out fines and penalties for violators, including fines of up to $1,500 per violation.

Cellular Telecommunications and Internet Association (CTIA)

The Cellular Telecommunications and Internet Association (CTIA), is a trade organization that represents the wireless communications industry in the United States, like Verizon and AT&T.

The organization sets industry standards and provides guidance and resources to its members, which include wireless carriers, device manufacturers, and mobile content providers. The CTIA also works to protect consumers by promoting the responsible use of wireless technology and advocating for policies that benefit the industry and its customers.

In relation to SMS marketing, the CTIA has established guidelines and best practices to help businesses comply with relevant laws and regulations, such as the federal TCPA.

While not adhering to CTIA guidelines does not necessarily result in legal action against your business, there can still be negative consequences for non-compliance. If the CTIA discovers that you have violated their rules, they may inform the mobile carriers about this violation. The mobile carriers could then suspend or terminate your access to their customers until you address the issue.

एक API

भेजना कैसे काम करता है

You send to every destination through the same endpoint and the same keys. Bird picks a compliant route for the country, applies opt-out handling on every message, and reports delivery from carrier receipts. The country-specific part is which sender you register. The API call does not change.

Sending to United States, answered

What senders ask before their first message to United States.

Do I need to register a sender before sending SMS to United States?
Yes. Every sender here must be registered before it can send: a short code, a toll-free number, and a 10DLC long code. For a 10DLC long code you register your brand and a campaign with The Campaign Registry, then link the number to that campaign. Messages flow once all three are approved. A toll-free number goes through toll-free verification instead, a separate process from 10DLC. Short codes are assigned by Bird rather than bought, and only reach numbers inside the country.
Can I use an alphanumeric sender ID in United States?
No. Bird offers a short code, a toll-free number, or a 10DLC long code here instead.
Can I receive replies from United States?
Yes, if you send from a short code, a toll-free number, or a 10DLC long code. Replies are delivered to you as signed webhooks.
Are there quiet hours for SMS in United States?
Yes. You may only send between 8:00 am and 9:00 pm in the recipient's local time.
Do I need consent before messaging someone in United States?
Yes. Under the Telephone Consumer Protection Act, prior express written consent is required. Every message must offer a way to opt out.
What other channels can Bird reach United States on?
WhatsApp and Voice, from the same account and API.
